Legal Advocacy
Program
Crisis Line & Safe House of Central Georgia assists
victims in completing the necessary paperwork to file Family Violence Protective Orders. There are two
types of orders that our agency prepares:
Family Violence Protective
Order
This order is necessary when an individual fears for their
safety and/or the safety of their children. There has usually been an incident of violence within the last
30 days prior to the first agency appointment. The perpetrator of violence must have a particular relationship
with the victim to qualify for this order. Those relationships include:
-
Present or past
spouses
-
Parents of the same
children
-
Parent and
child/ren
-
Persons who used to live in the
same household
-
Persons currently living in the
same household
-
Foster parent and foster
child
-
Stepparent and
stepchild
Family Violence Stalking
Order
This order is necessary when an individual is being
stalked or harassed by another person. There needs to be a pattern of harassing behavior and the victim
must have the necessary documentation to support their claim.
Important Information
If you are a victim of domestic violence and the
perpetrator has recently been arrested and released on bond, there may be a bond condition in place that
prohibits the perpetrator from having contact with you. This bond condition is enforceable by law
enforcement, however you need to contact the Magistrate Court/Warrant Division in the county in which they were
incarcerated and obtain a copy of the bond condition to show law enforcement. If you need assistance in
obtaining this information, please speak with an advocate.
Even if there is a bond condition in place and you can
obtain verification of this, please speak with a legal advocate about obtaining a protective order. A bond
condition is only in place while the bond is valid. Once there is a disposition in the case, the condition is
usually void. This may put you at further risk and you may want to take additional steps to protect you and
your family.
If you have any questions concerning the information
listed above please feel free to speak with a legal advocate.
